Demanda del Gobierno de Nicaragua ante la Corte Internacional de Justicia contra Alemania

Remitimos en español e inglés, importante Nota de Prensa sobre demanda de nuestro Gobierno ante la Corte Internacional de Justicia de La Haya contra Alemania por violaciones a la Convención de Genocidio.

NOTA DE PRENSA

El Gobierno de Reconciliación y Unidad Nacional informa al Pueblo de Nicaragua y a la comunidad internacional que hoy presentó una demanda ante la Corte Internacional de Justicia contra la República Federal de Alemania por violaciones a la Convención para la Prevención y la Sanción del Delito de Genocidio. Los Convenios de Ginebra de 1949 y sus Protocolos Adicionales, los principios intransgredibles del derecho internacional humanitario y otras normas imperativas del derecho internacional general en relación con el Territorio Palestino Ocupado, en particular la Franja de Gaza.

Hasta la fecha, de una población de aproximadamente 2,3 millones de personas, al menos 29.782 palestinos han muerto en Gaza y 70.043 han resultado heridos, lo que suma más de cien mil personas muertas, heridas o desaparecidas. Sólo en Gaza, mientras que 1,7 millones de personas han sido desplazadas por la fuerza. La mayoría se encuentra actualmente en la gobernación de Rafah, que se ha convertido en el campo de refugiados más grande del mundo.

Con todas las noticias públicas y videos disponibles de las atrocidades tal como ocurrieron, junto con las declaraciones de funcionarios internacionales y con la Orden de la Corte de 26 de enero de 2024; Alemania no puede negar su conocimiento de la grave ilegalidad de la conducta de Israel, ni puede negar que su conocimiento generó obligaciones para Alemania en virtud del derecho internacional de prevenir el genocidio, no ayudar ni asistir ni ser cómplice de genocidio, y garantizar el respeto de las normas de derecho humanitario internacional y otras normas imperativas del derecho internacional, como no prestar ayuda o asistencia y prevenir el régimen ilegal del apartheid y la negación del derecho de autodeterminación del pueblo palestino.

Alemania ha brindado apoyo político, financiero y militar a Israel sabiendo, en el momento de la autorización, que el equipo militar se utilizaría para cometer violaciones graves del derecho internacional. El Gobierno alemán también ha cortado la asistencia a la Agencia de Obras Públicas y Socorro de las Naciones Unidas para los Refugiados de Palestina en el Cercano Oriente (UNRWA por sus siglas en inglés), que es la principal agencia encargada de entregar ayuda a los Territorios Palestinos Ocupados. Las Naciones Unidas han confirmado que el UNRWA no puede ser reemplazado por ninguna otra agencia en este momento. Alemania es perfectamente consciente del impacto mortal que significa en términos prácticos su decisión de recortar la financiación al UNRWA, que equivale al castigo colectivo de millones de palestinos, en particular de los habitantes de Gaza, ya que estarán condenados a la hambruna, la inanición y las enfermedades si la UNRWA detiene su operaciones.

Ante esta situación, el 2 de febrero de 2024 Nicaragua envió una nota verbal a Alemania instando a su gobierno a detener inmediatamente el suministro de armas, municiones, tecnología y/o componentes a Israel y recordándole sus obligaciones bajo el derecho internacional. Nicaragua también reclamó la decisión de Alemania de suspender los fondos a la UNRWA. Lamentablemente, el suministro de armas militares y otro tipo de asistencia que pueda utilizarse en los actos ilícitos que se están cometiendo no ha cesado ni disminuido. De hecho, ha aumentado y ahora se suma a la inminente perspectiva de que UNRWA pronto detenga sus operaciones por falta de fondos.

Alemania continúa ignorando sus obligaciones y facilitando activamente las violaciones de las normas del derecho internacional por parte de Israel, en perjuicio grave e inmediato del pueblo palestino, en particular de los habitantes de Gaza, y de la comunidad internacional.

Nicaragua adopta esta decisión de conformidad con sus obligaciones bajo el derecho internacional de garantizar el respeto a estos textos internacionales fundamentales y al derecho internacional consuetudinario.

El Gobierno de Reconciliación y Unidad Nacional reafirma su firme compromiso con el Estado de Derecho a Nivel Internacional y la solución pacífica de controversias entre Estados.

The Government of Reconciliation and National Unity informs the people of Nicaragua and the international community that today it filed an Application before the International Court of Justice against the Federal Republic of Germany concerning violations to the Convention on the Prevention and Punishment of the Crime of Genocide, the Geneva Conventions of 1949 and its Additional Protocols, intransgressible principles of international humanitarian law and other peremptory norms of general international law in relation to the Occupied Palestinian Territory, particularly the Gaza Strip.

To date, out of a population of approximately 2.3 million people, at least 29,782 Palestinians have been killed in Gaza and 70, 043 have been injured, which adds up to more than one hundred thousand people that have been killed, injured, or are missing in Gaza alone, while 1.7 million people have been forcibly displaced. The majority are currently situated in Rafah governorate which has become the largest refugee camp in the world.

With all the public news reports and videos of the atrocities available as they occurred, along with the declarations of international officials and with the Order of the Court of 26 January 2024; Germany cannot deny knowledge of the serious illegality of the conduct of Israel, nor can it deny that its knowledge triggered obligations for Germany under international law to prevent genocide, to not aid and assist or be complicit in genocide, and to ensure respect for international humanitarian law and other peremptory norms of international law, such as not rendering aid or assistance and to prevent the illegal regime of apartheid and the negation of the right of self-determination of the Palestinian people.

Germany has provided political, financial, and military support to Israelwith the knowledge at the time of authorization that the military equipment would be used in the commission of serious breaches of international law. The German Government has also cut off assistance to the United Nations Relief and Works Agency for Palestine Refugees in the Near East (UNRWA), which is the primary agency in charge of delivering aid to the Occupied Palestinian Territories, the United Nations has confirmed that it cannot be replaced by any other agency at this time. Germany is perfectly aware of the deathly impact that its decision to cut funding to UNRWA means in practical terms, which amounts to the collective punishment of millions of Palestinians, in particular Gazans as they will be condemned to famine, starvation and disease if UNRWA halts its operations.

In light of this situation, on 2 February 2024 Nicaragua sent a note verbal to Germany urging its government to immediately halt the supply of arms, ammunitions, technology and/or components to Israel and reminding it of its obligations under international law. Nicaragua also called on Germany’s decision to suspend funds to UNRWA. Unfortunately, the provision of military weapons and other assistance capable of being used in the unlawful acts taking place has not stopped or diminished. It has in fact increased and is now coupled with the looming prospect of UNRWA soon halting its operations for lack of funds.

Germany continues to disregard its obligations, and to actively facilitate violations of the rules of international law by Israel to the severe and immediate prejudice of the Palestinian people, particularly Gazans, and the international community.

Nicaragua is adopting this decision in accordance with its obligations under international law to guarantee respect for these fundamental international texts and customary international law.

The Government of Reconciliation and National Unity reaffirms its firm commitment to the Rule of Law at the International Level and the peaceful settlement of disputes between States.
